Australian Sentencing: Principles and Practice explains the rules, principles, policies and practices that underpin the manner in which people are punished for criminal behaviour in Australia. It is the only book that examines sentencing law in all Australian jurisdictions. As well as dealing with sentencing law today, the book provides an extensive analysis of the wider policy, moral and political considerations that shape sentencing law. It analyses and evaluates existing standards and practices, and undertakes a normative and empirical analysis of the manner in which this area of law ought to be developed so that it operates in a more fair, efficient and effective manner.

Preface




Sentencing is a controversial and value laden area of the law. It dictates how the community deals with people who are felt to present a threat to some of the fabric that binds communities. Sentencing is the area of law where the State acts in its most coercive and authoritarian manner and hence it is vital that it is empirically and normatively justifiable.

    This book sets out the main sentencing principles that operate throughout Australia. Although sentencing law varies markedly throughout the nine Australian jurisdictions, there is sufficient underlying unity of principle to make a book of this nature not only possible but also desirable.

    Sentencing, perhaps more so than any other area of the law, is not a wholly academic or legalistic endeavour. Sentencing law is constantly in a state of flux and is often responsive to wider social and political developments.

    Thus, rather than merely summarising the existing state of sentencing law and practice, the book critiques the more important and controversial areas of sentencing and provides a moral and empirical analysis of the manner in which this area of law ought to develop.

    To this end, the book deals with four main themes. Part A sets out the theoretical framework of sentencing and the overarching legal principles that govern how the state punishes offenders. Part B explains and evaluates the main determinants relating to the choice of penalty. Part C discusses the range of sanctions that can be imposed on offenders. In the last section of the book, Part D, we suggest how sentencing law should be reformed to make it more coherent and justifiable.

    To the extent that the book examines existing legal principles, it principally focuses on Australian law. However, the theoretical dimensions of the book (especially chapters 1, 2, 3, 5, 8, 14 and 15) are of universal application and hence are of interest to sentencing scholars and practitioners in all jurisdictions.
